I, William Roman of Fayette County, and State of Kentucky, being of sound and disposing mind and memory, do make and publish this my last will and testament, hereby revoking all others.
It is my desire that after my death, all my just debts shall first be paid and so soon after my death as my executors shall think proper, all my estate, real, personal and mixed shall be sold and disposed of upon such terms and in such manner as my executors may think advisable, and my executors are hereby empowered to make a deed or deeds of conveyance, with general warranty to the purchaser or
purchasers of my estate.
It is my will, desire and order thay out of my estate, there be first paid to my beloved wife, Juretta, five thousand eight hundred dollars, being the amount I received from her upon our marriage. I also give to her a negro boy, Jack, now about ten years of age, being the same boy given her by Peter Higbee as a token of respect. I therefore do not wish to deprive her of him.
It is my will and desire that after the payment of my debts, and the five thousand eight hundged dollars (without interest) and the negro boy Jack, now about ten years of age, to my wife, that the remainder of my estate be divided equally, share and share alike between my wife Juretta, and my children, or their representatives, as follows:
To my wife Juretta, one share in lieu of dower, as expressed in a written contract made by her and me before marriage.
To my son, Wilson W. Roman, as trustee in trust for the benefit of his children, one share, he to have the use and management of said amount during his natural life. Said son Wilson shall not be required to give security as trustee of his children.
To my executors as trustees in trust for the use and benefit of the children of my daughter Sarah Stevens, one share, they (the executors) to have the management of said amount for their benefit. I
further will and authorize my executors to use the interest on the above amount (Sarah's portion) for the benefit of Elanor M. Stevens and Edwin K. Stevens, until Elanor becomes of age (if they remain in the state), at which time Luther Stevens and Elanor Stevens receive their portion, Edwin K Stephen's part to remain in the executor's hands until he becomes of age - in case one or more should die, the remaining ones or one to heir their parts - or if all should die, the property to fall back in my estate. (If the children shall want a negro, the executors shall be at liberty to buy one for each of them (at the children's risk).
To my executors as trustee in trust for the use and benefit of the children of my daughter Margaret Wallace, one share, they to have the management of said share for their benefit until Mary Elen Wallace
becomes of age, at which time William Wallace and Mary E. Wallace are to have their portion - Joseph's to remain in the executor's hands until he becomes of age - if one should die, the others to have their
part - or if all should die, their portion to fall back into my estate.
To my grandson William Maxwell, as trustee in trust for the use and benefit of my daughter Senia Maxwell during her life, one share and after her death, for her children, he to have the management of
said amount for their benefit, and after Sinia's death and the youngest child becoming of age, the legacy to be divided between the children of Sinai.
To my son Richare Roman, one share; should my son Richard die without issue, living, then in that case his portion is to be divided with his brothers and sisters or their heirs.
I have heretofore made advances in various amounts, and at different times to my children - Now it is my desire that in receiving the different shares which fall to each by the will, that there be an equalization of my accounts against them, so what they receive under the will in connection with advances which I have made, or may make, they may receive alike and my executors are instructed to deduct from one share, and pay to another so as to equalize the respective shares. The evidence of advances made by me heretofore, and which may be made by me after this date of this will, I have and will cause to be entered in a small book about six inches long, by four inches wide, with a reddish leather back and marble paper cover, with my name written on the first and last pages of said book with my own hand. Penalty of $50,000 with Wilson S. Hunt his seal conditioned according to law.

He went to a private school in Providence, KY [in Jessamine
County] and at age fourteen to the Masonic College of Lexington in MO,
graduating in 1854. Two years later he bought a side-wheeler steamer
"A.E. Ogden" for $27,000 and ran it for three years between St. Louis
and Omaha in the summer and between Nashville and New Orleans in the
winter. He returned to Lexington in Dec. of 1860 and when the war
broke out, he raised a company of cavalry and was made captain (Co. A
of the Sixth KY Cavalry U.S. under Col. Munday. He was with the
regiment one year but was forced to resign because of disability. He
went into the hat trade business which he retained until his death,
leaving no apparent children.

Miller formed a partnership with Samuel Redd to manufacture hemp bagging, probably mostly for tobacco. At the time, hemp was an important crop in Central Kentucky and related rope and bagging businesses flourished. Since Redd provided all the capital, he cut two agreements with Miller (Fayette deeds 17:337, 22 Feb 1840, and 18:351, 13 Jan 1841) which forced Miller to share in any losses incurred by the partnership despite his lack of investment.
